Saroj Kumari, headmistress of Etah’s primary school, applied for maternity leave immediately after the birth of a child, which was rejected by the District Basic Education Officer, saying that maternity leave cannot be taken after the birth of a child. That’s why asked to apply for child care leave. On this Saroj approached the High Court. Argued that child care leave does not have the benefits of maternity leave and under the Maternity Benefit Act 1961, maternity leave can be taken before or after the birth of the child.
